Terms of Service

About JaJong

JaJong is a technology-enabled online marketplace that facilitates introductions and booking arrangements between users and independent third-party service providers offering accommodation, activities, and other related services.

JaJong does not own, manage, operate, or control any accommodation, activity, or service listed on the Platform. All services are independently provided and performed by third-party service providers, who are solely responsible for the quality, safety, legality, and delivery of their services.

JaJong’s role is limited to providing the Platform that enables users to discover, book, and pay for services offered by independent service providers. In connection with payment transactions, JaJong may act as a limited payment collection agent on behalf of the service provider for the purpose of facilitating payments through the Platform.

Nothing in these Terms shall be deemed to create any agency, employment, partnership, joint venture, tour operator, travel agency, or other similar relationship between JaJong and any service provider. Service providers operate as independent contractors and are not employees, agents, or representatives of JaJong.

PART A: FOR USERS (Guests)

1. Using the Platform and Making a Reservation

Users may browse, select, and request to book accommodation, activities, and other services listed on the Platform. All listings are created and managed by independent service providers.

Each listing includes information provided by the relevant Service Provider, including pricing, availability, house rules, cancellation terms, and additional requirements.

Users are responsible for reviewing all listing details carefully before submitting a reservation request.

Reservation requests are subject to availability and acceptance by the relevant Service Provider.

2. Reservation Confirmation and Contract Formation

A legally binding agreement is formed directly between the User and the relevant Service Provider upon confirmation of a booking.

JaJong is not a party to the agreement between Users and Service Providers and does not assume responsibility for the performance of the booked services.

Users acknowledge that the Service Provider is solely responsible for fulfilling the confirmed reservation in accordance with the listing terms.

3. Cancellations, Changes, and Refund Eligibility

Cancellation and modification policies are determined by the respective Service Provider and are displayed on each listing.

Refund eligibility is governed by the cancellation policy applicable at the time of booking. Users are encouraged to review these terms carefully before confirming a reservation.

Requests for changes or refunds outside the stated policy may be considered at the discretion of the Service Provider.

In limited circumstances, such as force majeure events, additional review may be conducted in accordance with Platform policies.

4. Fees, Payments, and Promotional Credits

Users agree to pay the total amount displayed at checkout, including the service price, applicable taxes, service fees, and any additional charges disclosed prior to confirmation.

Payments are processed through the Platform. Upon successful payment, JaJong facilitates the transfer of funds to the relevant Service Provider in accordance with its payout policies.

All payments are processed in the currency displayed at checkout. Currency conversion rates may vary depending on payment provider.

Promotional codes, credits, or discounts may be offered from time to time and are subject to separate terms and conditions.

5. User Conduct and Platform Rules

Users agree to:

  • Provide accurate and complete information;
  • Comply with house rules and service-specific requirements;
  • Respect applicable local laws and regulations;
  • Communicate respectfully with Service Providers.

Users may not circumvent the Platform by arranging payments or bookings outside JaJong for services originally introduced through the Platform.

Violation of these rules may result in suspension or termination of the User’s account.

6. Risk Acknowledgement and Limitation of Platform Liability

Users acknowledge that accommodations, activities, and services listed on the Platform are provided by independent Service Providers.

To the fullest extent permitted by applicable law, JaJong shall not be liable for indirect, incidental, consequential, or punitive damages arising from bookings made through the Platform.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

PART B: FOR SERVICE PROVIDERS

7. Becoming a Service Provider on JaJong

To offer services on JaJong, an applicant must complete the registration and verification process required by the Platform.

Applicants may be required to submit identification documents, business registration details, licenses, permits, certifications, tax information, or other documentation necessary to verify eligibility and legal compliance.

Approval to list services on the Platform is granted at JaJong’s sole discretion. JaJong reserves the right to approve, reject, suspend, or remove any Service Provider or listing that does not meet Platform standards or applicable legal requirements.

Service Providers must maintain all required licenses, permits, registrations, and regulatory approvals at all times while offering services on the Platform.

Service Providers must promptly notify JaJong of any change in legal status, licensing, eligibility, or regulatory standing that may affect their ability to provide services.

JaJong reserves the right to request updated documentation or conduct additional verification at any time.

Service Providers operate as independent contractors and are solely responsible for the operation and delivery of their services. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between JaJong and any Service Provider.

8. Categories of Services

For the purpose of these Terms, "Service Provider" may include:

  • (a) Accommodation Providers
  • (b) Activity Operators
  • (c) Independent Service Providers

A Service Provider may offer one or more categories of services through the Platform.

Each category may be subject to additional operational or regulatory requirements depending on the nature of the service and applicable local laws.

9. Listing Creation and Accuracy of Information

Service Providers are responsible for ensuring that all listing information is accurate, complete, and up to date.

This includes, but is not limited to:

  • Description of services
  • Pricing and fees
  • Availability
  • House rules or service conditions
  • Cancellation policies
  • Required qualifications or restrictions

Service Providers must not misrepresent the nature, legality, or quality of the services offered.

JaJong may remove or suspend listings that contain misleading, inaccurate, or unlawful information.

10. Legal Compliance and Licensing Requirements

Each Service Provider represents and warrants that they comply with all applicable laws and regulations governing the services they offer.

Depending on the nature of the service, this may include:

  • Accommodation Providers: holding valid lodging, rental, or hospitality licenses as required by applicable law;
  • Activity Operators: complying with relevant local safety, tourism, or commercial regulations;
  • Transportation-related services: complying with applicable transport and driver regulations and not operating unlawful transport services;
  • Photography or other regulated services: holding any required commercial permits where applicable.

Service Providers are solely responsible for obtaining, maintaining, and renewing any necessary licenses or permits.

JaJong does not independently verify the ongoing legal status of each Service Provider and does not assume responsibility for regulatory compliance.

11. Booking Management, Cancellations, Modifications and No-Show

Service Providers are responsible for managing confirmed bookings in accordance with the terms displayed on their listing.

Service Providers must honor confirmed reservations unless cancellation is permitted under their stated cancellation policy or required by law.

Failure to fulfill confirmed bookings without valid justification may result in penalties, temporary suspension, or removal from the Platform.

11.1 Booking Management

(A) Accommodation Bookings

Accommodation Providers must ensure that the property is available, safe, and materially consistent with the listing description at the time of check-in.

Overbooking or unjustified cancellations may result in Platform action.

(B) Activity Bookings Activity Operators are responsible for conducting activities in a safe and professional manner, including providing required equipment, instructions, and safety precautions as applicable.

(C) Service Appointments Independent Service Providers must deliver the agreed service at the scheduled time and location, subject to reasonable changes agreed with the User.

11.2 Provider-Initiated Cancellation

Service Providers may cancel a confirmed booking only where:

  • Permitted under the stated cancellation policy;
  • Required by law; or
  • Justified by exceptional circumstances.

All cancellations must be processed through the Platform.

Provider-initiated cancellations may result in penalties as set out in the Cancellation, No-Show & Refund Policy

11.3 User-Initiated Cancellation

Users may cancel bookings in accordance with the cancellation policy displayed in the listing at the time of booking.

Refund eligibility shall be determined based on the Cancellation, No-Show & Refund Policy :

  • The applicable cancellation policy;
  • Timing of cancellation;
  • Applicable processing fees.

11.4 Modifications

Users and Service Providers may request reasonable modifications to a confirmed booking, including changes to dates, duration, number of participants, or other booking details, subject to the approval of the Service Provider.

Any modification may result in a change to the total booking price based on the updated service details.

Where a modification involves payment adjustments, additional charges or refunds may apply. Such adjustments may include applicable platform fees, payment processing fees, currency conversion fees, or other administrative charges associated with the modification.

JaJong reserves the right to process any required payment adjustments through the Platform before confirming the modified booking.

11.5 No-Show

A “No-Show” occurs when a User fails to attend, check in, or appear for a confirmed booking without prior cancellation in accordance with the applicable cancellation policy.

No-Show situations shall be governed by the Platform’s No-Show Policy, which forms part of these Terms and may be updated from time to time.

The No-Show Policy sets out, among other matters:

  • Refund eligibility for Users;
  • Payout treatment for Service Providers;
  • Reporting requirements; and
  • Any applicable documentation standards.

Refunds and payouts in No-Show situations shall be determined in accordance with the No-Show Policy and the applicable payout schedule.

11.6 Fraud Prevention and Risk-Based Cancellation

JaJong reserves the right to review, suspend, or cancel any booking where fraud, payment risk, suspicious activity, identity verification concerns, or security risks are reasonably suspected.

In such circumstances, JaJong may take appropriate action, including but not limited to:

  • reviewing the booking or related account activity;
  • temporarily suspending or terminating the User account involved;
  • requesting additional verification, identification, or supporting documentation; and
  • cancelling the affected booking or withholding, reversing, or adjusting related payments.

Where appropriate, JaJong may notify the relevant Service Provider and issue a refund to the Guest in accordance with the Platform’s applicable policies.

JaJong may also request additional verification or documentation from the parties involved before allowing the booking to proceed.

Any actions taken under this Section are intended to protect the security, integrity, and proper operation of the Platform and its users.

12. Fees, Commission, and Payout

JaJong charges a commission or service fee for bookings facilitated through the Platform based on Commission Structure Policy. The applicable fee structure will be communicated separately and may vary depending on service category.

Upon successful completion of a booking, JaJong facilitates payout to the Service Provider in accordance with its payout schedule.

JaJong may withhold or adjust payouts in cases of disputes, chargebacks, cancellations, policy violations, or suspected fraud.

13. Taxes and Regulatory Responsibility

Service Providers are solely responsible for understanding and complying with all tax and regulatory obligations applicable to the services they offer through the Platform.

Except as expressly stated in this Section, JaJong does not assume responsibility for tax compliance on behalf of Service Providers.

13.1 Accommodation and Local Taxes

Where required or permitted by applicable local regulations, JaJong may collect accommodation tax or similar local lodging taxes from Users on behalf of the relevant Service Provider and remit such amounts to the appropriate local authority.

JaJong does not assume responsibility for independently determining the accuracy of any tax rate, except where required by applicable law.

13.2 Income and Withholding Taxes

Each Service Provider is solely responsible for the reporting and payment of all income taxes, withholding taxes, consumption taxes, and any other taxes arising from the provision of their services.

JaJong does not assume responsibility for calculating, withholding, or remitting income-based taxes on behalf of Service Providers unless required by applicable law.

Service Providers acknowledge that JaJong may be required by law to report transaction information to relevant tax authorities.

13.3 Tax Information

Service Providers are responsible for providing accurate tax registration information and documentation as required by applicable law.

Failure to provide required tax information may result in suspension of payouts or account access.

14. Service Provider Agreement and Termination

This Section governs the contractual relationship between JaJong and Service Providers, including Accommodation Providers (“Hosts”) and other independent Service Providers as well as the rights of each party to terminate participation on the Platform.

14.1 Nature of the Agreement

The relationship between JaJong and each Service Provider is non-exclusive and independent in nature.

Nothing in these Terms shall be construed as creating:

  • An employment relationship;
  • A partnership or joint venture;
  • An agency relationship;
  • Any fiduciary obligation beyond those expressly stated herein.

Each Service Provider acts as an independent contractor and is solely responsible for the services offered through the Platform.

Acceptance of these Terms through the Platform constitutes a legally binding agreement.

14.2 Term of the Agreement

This Agreement shall commence upon acceptance of these Terms and shall continue for an indefinite period unless terminated in accordance with this Section.

14.3 Termination by the Service Provider

A Service Provider may terminate participation on the Platform at any time by deactivating listings or providing written notice.

Termination does not relieve the Service Provider from:

  • Fulfilling confirmed bookings;
  • Complying with applicable cancellation policies;
  • Settling outstanding fees or penalties.

14.4 Termination by JaJong

JaJong reserves the right to suspend or terminate a Service Provider’s account, remove listings, or withhold payouts where:

These Terms or Platform policies are violated;

Required licenses or regulatory compliance are not maintained;

Information provided is inaccurate or misleading;

The Service Provider poses a safety, legal, or reputational risk.

JaJong may take such actions with or without prior notice where reasonably necessary.

14.5 Cancellation Penalties

(A) Accommodation Providers (Hosts)

If a Host cancels a confirmed reservation prior to guest check-in, penalties may apply as set out in the applicable Host Cancellation Policy.

JaJong may impose monetary penalties, listing visibility reduction, calendar blocking, or temporary suspension.

Applicable penalties may be deducted from future payouts or recorded as outstanding balances.

(B) Other Service Providers

If a Service Provider cancels a confirmed booking without valid justification:

  • Monetary penalties may apply;
  • Temporary suspension may be imposed;
  • Repeated violations may result in permanent termination.

Specific penalty amounts and thresholds may be set out in the applicable Service Provider Policy.

JaJong reserves discretion to determine appropriate enforcement measures.

15. Effect of Termination

This Section governs the legal and financial consequences following termination of participation by a Service Provider.

15.1 Confirmed Bookings

Confirmed bookings made prior to termination may:

  • Remain valid and require fulfillment; or
  • Be cancelled at JaJong’s discretion in accordance with applicable policies.

JaJong may determine the appropriate course of action to protect Users and maintain platform integrity.

15.2 Outstanding Payments and Obligations

Termination does not affect JaJong’s right to:

  • Deduct unpaid commissions, fees, or penalties from pending payouts;
  • Record unpaid amounts as outstanding balances;
  • Seek lawful recovery of outstanding sums.

Obligations arising prior to termination shall remain enforceable.

15.3 Survival of Provisions

The following provisions shall survive termination:

  • Liability and indemnification obligations;
  • Tax responsibilities;
  • Limitation of liability;
  • Dispute resolution provisions;
  • Any provision intended by its nature to survive termination.

PART C: GENERAL PROVISIONS

16. Ratings and Feedback System

Users and Service Providers may leave ratings and written feedback following the completion of a booking.

All reviews must be based on genuine experiences and must not contain false, misleading, defamatory, abusive, or unlawful content.

JaJong reserves the right to remove or restrict reviews that violate Platform policies, including but not limited to fraudulent, retaliatory, or irrelevant content.

JaJong does not guarantee the accuracy of reviews and does not independently verify each statement made in user-generated feedback.

17. User-Generated Content and Intellectual Property

Users and Service Providers may upload content to the Platform, including text, images, descriptions, and other materials (“User Content”).

By submitting User Content, the submitting party grants JaJong a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content for the purpose of operating, promoting, and improving the Platform.

The submitting party represents and warrants that they have the necessary rights to upload and share such content and that the content does not infringe upon any third-party rights.

JaJong reserves the right to remove content that violates these Terms or applicable law.

The Platform, including its software, design, trademarks, logos, content structure, and underlying technology, is owned by JaJong or its licensors and is protected by applicable intellectual property laws.

Users and Service Providers are granted a limited, non-transferable, non-exclusive right to access and use the Platform solely for its intended purpose.

Users and Service Providers may upload content to the Platform (“User Content”). By submitting User Content, the submitting party grants JaJong a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute such content for the purpose of operating, promoting, and improving the Platform.

The submitting party represents and warrants that they have all necessary rights to submit such content and that it does not infringe any third-party rights.

Any feedback, suggestions, or ideas provided to JaJong regarding the Platform may be used by JaJong without restriction or compensation.

JaJong reserves the right to remove content that violates these Terms or applicable law.

18. Platform Fees and Charges

JaJong may charge service fees, commissions, or other applicable charges in connection with bookings facilitated through the Platform.

All applicable fees will be disclosed prior to confirmation of a booking or listing activation, as applicable.

JaJong reserves the right to modify its fee structure upon reasonable notice.

19. Acceptable Use and Community Standards

Users and Service Providers agree to use the Platform in a lawful, respectful, and responsible manner.

Prohibited conduct includes, but is not limited to:

  • Providing false or misleading information
  • Circumventing the Platform’s payment system
  • Engaging in fraud, harassment, discrimination, or unlawful activity
  • Violating applicable laws or third-party rights

JaJong reserves the right to investigate suspected violations and take appropriate action.

20. Account Suspension and Termination Rights

JaJong may suspend at its reasonable discretion, restrict, or terminate access to the Platform in cases of:

  • Violation of these Terms
  • Repeated cancellations or failure to honor bookings
  • Fraudulent or abusive behavior
  • Regulatory or legal concerns

Where appropriate, JaJong may provide notice prior to suspension; however, immediate action may be taken where necessary to protect users, service providers, or the integrity of the Platform.

21. Amendments to These Terms

JaJong may update or modify these Terms from time to time to reflect changes in legal requirements, Platform features, business practices, or other operational needs.

Material changes will be communicated through reasonable means, including publication on the Platform or notification to registered users.

Unless otherwise stated, updated Terms will become effective upon publication.

Continued access to or use of the Platform after the effective date constitutes acceptance of the updated Terms.

22. Complaints, Dispute Handling and Damage Claims Process

Users and Service Providers agree to first attempt to resolve any complaint or dispute directly between themselves.

JaJong may, at its discretion, assist in facilitating communication between the parties; however, JaJong does not act as a mediator, arbitrator, or legal representative of either party unless expressly stated.

Any claims relating to property damage, service failure, refunds, or misconduct must be supported by reasonable documentation, including photographs, written explanations, or other relevant evidence.

JaJong reserves the right to temporarily withhold payouts or take appropriate action while a complaint or dispute is under review.

Final determinations made by JaJong regarding Platform-related matters shall be binding solely for the purpose of internal Platform resolution and do not prevent either party from seeking legal remedies in accordance with applicable law.

23. Nature of the Platform and No Agency Relationship

JaJong operates as an intermediary technology platform that facilitates connections and booking arrangements between Users and independent Service Providers.

JaJong does not own, operate, manage, control, or provide the underlying accommodation, activities, or services listed on the Platform.

Nothing in these Terms shall be construed as creating an agency, employment, partnership, joint venture, franchise, or representative relationship between JaJong and any Service Provider.

Service Providers operate as independent contractors and are solely responsible for the operation, performance, and legality of their services.

24. Account Registration and Security

Users and Service Providers are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their accounts.

Accounts may not be transferred, assigned, or shared without prior written consent from JaJong.

JaJong must be promptly notified of any unauthorized access or suspected security breach.

JaJong is not liable for losses resulting from unauthorized use of an account unless caused by JaJong’s gross negligence or willful misconduct.

25. Disclaimer of Representations and Warranties

The Platform is provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, JaJong disclaims all representations and warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

JaJong does not guarantee the accuracy, completeness, legality, safety, or suitability of any listing or service offered through the Platform.

Nothing in these Terms excludes warranties that cannot be lawfully excluded.

26. Limitation of Liability

To the fullest extent permitted by applicable law, JaJong shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to the use of the Platform or any booking made through the Platform.

JaJong’s total aggregate liability for any claim arising out of or relating to these Terms or the use of the Platform shall not exceed the total service fees received by JaJong in connection with the specific booking giving rise to the claim.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or liability that cannot be excluded under applicable law.

These limitations form an essential basis of the agreement between the parties.

27. Indemnification

Users and Service Providers agree to indemnify, defend, and hold harmless JaJong, its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and professional fees) arising out of or related to:

  • (a) any breach of these Terms or applicable policies;
  • (b) misuse of the Platform;
  • (c) interactions between Users and Service Providers, including any injury, loss, damage, or dispute arising from accommodation, activities, or services;
  • (d) violation of any applicable laws or regulations;
  • (e) infringement of any third-party rights, including intellectual property, privacy, or contractual rights;
  • (f) failure to accurately report, collect, or remit taxes where legally required.

This indemnification obligation survives termination of these Terms.

Nothing in this Section requires indemnification to the extent the claim arises from JaJong’s gross negligence or willful misconduct.

28. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which JaJong is legally incorporated, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of such jurisdiction, unless otherwise required by applicable law.

Before initiating formal legal proceedings, the parties agree to make reasonable efforts to resolve disputes in good faith through direct communication.

Nothing in this Section prevents either party from seeking injunctive or equitable relief where appropriate.

29. Force Majeure

This Section governs circumstances in which extraordinary events beyond the reasonable control of the parties prevent the fulfillment of a confirmed booking. The purpose of this clause is to ensure fairness, transparency, and risk allocation in situations where performance becomes objectively impossible.

29.1 Definition of Force Majeure

“Force Majeure” refers to events beyond the reasonable control of the Host, Guest, or JaJong that prevent the Guest from traveling to, accessing, or using the booked accommodation or service as intended.

Force Majeure events may include, but are not limited to:

  • Severe natural disasters (such as earthquakes, typhoons, floods, or similar catastrophic events);
  • Official government orders, travel bans, or regulatory restrictions;
  • Suspension or disruption of major transportation systems;
  • Public health emergencies or officially declared epidemics or pandemics.

Force Majeure applies only where the event directly and materially prevents performance of the booking.

29.2 Effect on Booking

In the event of a confirmed Force Majeure situation, JaJong reserves the right to:

  • Override the applicable cancellation policy; and
  • Cancel the affected reservation.

Such action may be taken to ensure equitable treatment of both parties and to reflect the impossibility of performance.

29.3 Refund Handling

Where a booking is cancelled due to Force Majeure:

  • The Guest shall be entitled to a full refund of amounts paid for the affected booking;
  • The Host shall not be entitled to payout for the cancelled period;
  • JaJong shall not charge commission for the cancelled booking.

Refunds will be processed in accordance with the Platform’s standard refund procedures.

29.4 Case-by-Case Assessment

Force Majeure claims will be assessed on a case-by-case basis.

JaJong may consider:

  • Supporting documentation or evidence;
  • Official government announcements;
  • The factual circumstances affecting the booking.

JaJong’s determination regarding Force Majeure status shall be final for platform administration purposes.

29.5 Exclusions

The following circumstances do not constitute Force Majeure:

  • Changes in personal travel plans;
  • Personal concerns or risk perception;
  • Seasonal weather conditions that do not prevent access or use of the service;
  • Situations in which the Guest is still reasonably able to access and use the booked accommodation or service.

30. Insurance and Liability Allocation

This Section clarifies the allocation of risk, insurance responsibilities, and damage handling procedures between Guests, Accommodation Providers, and JaJong. JaJong operates as a technology platform and does not provide automatic insurance coverage for bookings facilitated through the Platform.

30.1 No Automatic Insurance Coverage

JaJong does not provide automatic insurance coverage, host protection programs, or damage protection guarantees for bookings made through the Platform.

JaJong does not act as an insurer and does not assume the role of an insurance provider for Hosts or Guests.

Any insurance coverage must be independently arranged by the relevant party.

30.2 Host Responsibility for Insurance

Each Accommodation Provider is solely responsible for maintaining appropriate insurance coverage for their property and operations.

Hosts are encouraged to maintain:

  • Property insurance covering physical damage to the accommodation;
  • Liability insurance covering claims arising from guest injury or third-party damage.

Hosts should ensure that their insurance policies expressly permit short-term rental or guest occupancy use.

JaJong does not verify, guarantee, or assume responsibility for the adequacy or validity of any insurance coverage maintained by Hosts.

30.3 Security Deposits and Damage Claims

Accommodation Providers may specify damage-related terms in their listing, including whether a security deposit is required.

If a Host seeks to recover damages through JaJong, any payment request must be processed through the Platform’s designated payment system.

Damage payments processed through the Platform shall be subject to applicable payment processing fees, transaction charges, and bank transfer costs. Such fees may be deducted from the recovered amount prior to payout to the Host.

JaJong does not assume responsibility for collecting damages outside of the Platform’s payment system and does not guarantee recovery of disputed amounts.

All damage-related conditions must be clearly disclosed in the listing prior to booking.

30.4 Guest Responsibility

Guests are responsible for:

  • Damage to property;
  • Loss of items;
  • Additional cleaning costs arising from misuse or abnormal use of the accommodation.

JaJong may assist in facilitating communication between the parties but does not assume primary liability for damage resolution.

30.5 Damage Reporting Process

If a Host believes that damage has occurred, the Host must report the issue within 14 days following guest check-out.

Damage claims must include supporting documentation, such as:

  • Photographic evidence;
  • Repair estimates or cost assessments.

JaJong reserves the right to:

  • Review submitted documentation;
  • Temporarily withhold payout in the event of a dispute.

Failure to submit claims within the specified timeframe may result in the claim being declined.

30.6 Limitation of Platform Liability

To the maximum extent permitted by applicable law, JaJong shall not be liable for:

  • Property damage;
  • Personal injury;
  • Loss of personal belongings;
  • Any indirect, incidental, or consequential damages arising from the use of the accommodation.

Nothing in this Section excludes liability where such exclusion is prohibited by applicable law.

30.7 Dispute Resolution Support

JaJong may, at its discretion:

  • Facilitate communication between Guests and Hosts;
  • Conduct preliminary review of submitted information.

Final resolution of damage disputes shall be determined in accordance with the agreement between the Guest and Host and applicable law.

JaJong’s involvement does not constitute acceptance of liability.

31. Safety and Misconduct Reporting

JaJong is committed to maintaining a safe and respectful environment for all Users and Service Providers. This Section governs the reporting and handling of conduct that may compromise safety, legality, or community standards on the Platform.

31.1 Prohibited Conduct

The following conduct is strictly prohibited on the Platform, whether by Guests, Hosts, or other Service Providers:

  • Harassment, threats, or abusive behavior;
  • Sexual misconduct or exploitation;
  • Violence or endangerment of persons;
  • Fraudulent activity or misrepresentation;
  • Unauthorized surveillance or invasion of privacy;
  • Illegal activities conducted in connection with a booking;
  • Use of accommodation or services for unlawful purposes;
  • Providing services without required licenses or regulatory compliance.

JaJong reserves the right to determine, in its sole discretion, whether conduct constitutes a violation of this Section.

31.2 Reporting Mechanism

Any party may report safety concerns or misconduct through the Platform’s designated reporting channels.

Reports should include relevant details and supporting evidence where available.

JaJong may request additional information in order to assess the situation.

31.3 Platform Actions

Upon receiving a report, JaJong may, at its discretion:

  • Temporarily suspend an account;
  • Remove listings or service offerings;
  • Withhold payout pending review;
  • Permanently terminate access to the Platform.

Such actions may be taken as precautionary measures to protect the integrity of the Platform and its users.

31.4 Limitation of Platform Authority

JaJong is not a law enforcement authority and does not conduct criminal investigations.

Where appropriate, JaJong may cooperate with governmental or regulatory authorities in accordance with applicable law.

Platform decisions regarding account suspension or termination are administrative actions and do not constitute legal determinations of guilt or liability.

31.5 No Obligation to Monitor

JaJong does not proactively monitor all user conduct and shall not be liable for the actions of Guests, Hosts, or Service Providers.
